Terms of Service

By creating an account or using Ground Wise (“the Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old, and if you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

Ground Wise is a subscription software platform that helps lawn care businesses manage customers, plan and optimize routes, run their service day, generate invoices, and track operations. We may add, change, or remove features over time as the product evolves.

You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate account information and keep it current. Notify us promptly at the contact address below if you suspect unauthorized access to your account.

New accounts receive a 30-day free trial with full access to all features. A valid payment method is required to start the trial. You will not be charged until the trial ends, and you may cancel at any time before then to avoid any charge.

• After your trial, Ground Wise is $40/month, billed monthly in advance.
• Your subscription renews automatically each month until canceled.
• Payments are processed securely by Stripe; we never store your card number.
• If a payment fails, Stripe will retry it and we will notify you. Access may be suspended if payment cannot be collected.
• We may change our pricing with at least 30 days’ advance notice by email. Price changes take effect at your next billing cycle after the notice period; if you don’t agree, you may cancel before the new price applies.

You may cancel anytime from the Billing page. Cancellation takes effect at the end of your current billing period, and you keep access until then. Fees already paid are non-refundable, including for partial billing periods, except where required by law.

You own the business and customer data you enter into Ground Wise. You grant us a limited license to host, process, and display that data solely to provide the Service to you. You are responsible for ensuring you have the right to store and use any data you upload, and you agree not to upload illegal, harmful, or infringing content. Upon account closure, your data is deleted as described in the Privacy Policy.

• Use the Service only for lawful purposes and in accordance with these Terms.
• Do not attempt to reverse engineer, copy, resell, or sublicense the Service.
• Do not probe, scan, or test the vulnerability of the Service, attempt to access other accounts’ data, or interfere with the Service’s operation.
• Do not place excessive automated load on the Service (scraping, bulk API abuse, or similar).

Route orders, drive-time and mileage estimates, schedule suggestions, and fuel-station results are informational estimates generated from third-party mapping data, which may be incomplete or out of date. They are not a substitute for your own judgment. You are solely responsible for operating vehicles safely, obeying traffic laws, verifying that suggested routes and stops are appropriate, and confirming any fuel-price or location information before relying on it.

We work to keep Ground Wise available and fast, but we do not guarantee uninterrupted or error-free operation, and no specific uptime is promised. The Service may be briefly unavailable during maintenance or due to failures of third-party providers (hosting, database, payments, or mapping).

You may stop using the Service and cancel at any time. We may suspend or terminate your account if you materially violate these Terms, if required by law, or if your payment cannot be collected after reasonable retries and notice. If we terminate without cause, we will refund the prorated remainder of your current billing period. After termination, your data is handled per the Privacy Policy’s deletion terms.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Ground Wise and its owner are not liable for any indirect, incidental, special, or consequential damages — including lost profits, lost data, business interruption, or vehicle- and property-related losses — arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.

You agree to indemnify and hold harmless Ground Wise and its owner from claims, damages, and reasonable legal fees arising out of the data you upload, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Service.

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally within 30 days. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Georgia.

We may update these Terms from time to time. For material changes we will notify you by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
